The vacation rental of this villa is direct between the landlord and tenant. Playa Arena acts as an agent of the owner and is responsible only for the exercise of mediation and economic transmission of both parties. Playa Arena will not accept liability for more than the amount of the rent paid by the tenant.
The contract reflects the two parties and the terms and conditions of payment, deposit dates and special conditions. Only between these parties originate rights and obligations of the contract.
It can happen in the case of special offers that the same type of accommodation has a different price.
The permanent address of the tenant is registered in his passport or identity card, so he accepts that rental of the unit is for the sole purpose of short term holiday use only and not for permanent residence of any kind.
Neither the Landlord nor Playa Arena can be held liable for the tenants use of the facilities, services or supplies of the rented house and its location. The use of private pools is at the sole risk of the tenant/s.
The tenant is obliged to take care of the furnished accommodation, being responsible for the damage or loss occurring therein, whether caused by the tenant or persons living in this dwelling. The deposit serves as a guarantee held for the duration of the contract.
Renters may under no circumstances have combustible, explosive or corrosive materials, neither exercise any kind of business, immoral or unusual activity, by which may cause inconvenience to other residents of the area in which the property is located.
Due to the lack of rainfall in the main and off-season and the high risk of fire, open fires are strictly prohibited. The BBQ’s/grills must be strictly controlled. We strongly recommend that the tenant takes out a travel insurance which incorporates fire protection for the holiday.
The landlord has the obligation to maintain and pay for house insurance and the provision of water, electric and gas etc.(where relevant).
All accommodations have a deposit, of which the amount varies depending upon the rental property. Upon arrival, the deposit is to be paid in cash and will be returned after the end of the stay, in cash or by bank transfer, within a few days after departure. It will be refunded in full if the property is found in good condition. Please notify us within the first 24 hours after arrival of any existing damage in the property.
If during your stay an injury or accident should occur, please immediately contact Playa Arena, who will assist where possible. The tenant is, in any case, responsible for any damage caused by him or a roommate during their stay.
Rules that have to be considered by the tenants
Upon arrival and during your stay, we reserve the right of admission.
Under no circumstances may the maximum number of occupants for the property (including children), as stated in the contract, be exceeded. During your stay, it is totally prohibited for any tents or caravans to be sited on the property. Some of our properties will not be rented to groups of the same sex aged under 25 years of age.
The tenant must abide by the rules that have been set by the owner, the estate and the community. If they become aware of and report any inappropriate behaviour by the tenant or fellow occupants, including excessive noise etc,the tenant will be given an initial warning. If after this initial warning there is renewed violation, the landlord is entitled to terminate the lease and to carry out the eviction at the expense of the tenant. There is no right or claim to repayment of the paid rental fee. The deposit is refundable depending on the condition of the property.
In the case of cancellations, the following expenses will be deducted from the total rental:
- Up to 46 days before arrival: 25%
- From 36 to 45 days before arrival: 50%
- From 4 to 35 days before arrival: 80%
- From the third day prior to arrival or no show: 90%.
Playa Arena will only accept the cancellation of the reservation in writing together with a copy of the plea due to the ‘force majeure’, and only for the following reasons: death of a family member or personal or family accident. We recommend that you have full travel insurance arranged.

Should the reserved accommodation not be available upon arrival by ‘force majeure’ or any other reason, Playa Arena will recommend a similar property. If this is not to your liking and there is no alternative, Playa Arena will pay back the amount paid. The tenants will have no right to ask for more than this amount.
The lease is issued in the name of the tenant and therefore can not be even partially transferred to another person. Here, the tenant waives the paragraphs 31, 32 and 33 of the Rent Act, thus, in leasehold law, subrogation, assignment or transfer, whether in whole or in part is not permissable.
Determined as described in paragraph 3 of Article 4 of the current Rental Act, the rental agreement depends on the paragraph of the Civil Code. Failure to comply with this obligation, the landlord must as a penalty, pay an amount equal to three times the daily rent, for the weeks of free availability of the property by the owner, regardless of the costs, expenses, indemnities and legal costs and attorney where responsible, even if intervention was not necessary.
Under current legislation on data protection, the customer agrees that its data can be recorded in a file and used for the lease. At any time they may exercise their rights of access, rectification or cancellation
